Corey's Construction Design Agreement

Building your new dream home is a long journey - thank you for allowing us to be a part of this project. The first step is for you to read and acknowledge this design agreement to start our process together.

DESIGN AGREEMENT CLAUSE

Corey’s Construction, together with you, the Client, will begin the process of designing, budgeting, and planning towards a full contract. This agreement authorizes Corey’s Construction to work with the Client towards full construction drawings, a site plan, completion of all material selections, and the development of a full project contract. This agreement is not a commitment to construction; rather, it is a commitment to work together towards a final contract, using the process defined in the document “Your Home: From Design Agreement to Final Contract.”

NON-REFUNDABLE DESIGN DEPOSIT:

The Design Deposit is a deposit towards your home and will be reflected as a credit on your final budget.


Corey’s Construction offers a wide variety of floor plans, at different levels of modification, customization, and design labor. The initial deposit varies based on the plan you choose:


  • $2,500 deposit: Base Level Collection - Homestead Series

  • $4,000 deposit: Benchmark Collection - American Dream, Coastal Lifestyles, the Modern Series, and Corey’s Construction’s Lake and Lodge Series

  • $5,000 deposit: Custom Modular Floor Plan

WHAT'S INCLUDED

The entire home needs to be designed, and a proposed site plan must be developed before a final contract can be created. In order for Corey’s Construction to move to the permit stage, the Client must sign their final contract, and Corey’s Construction needs payment of the first draw. Corey’s Construction will complete the following:


A FULL DESIGN OF ONE (1) SELECTED FLOOR PLAN. This will require a design consultation meeting. Our first design consultation will cover the entire structure and budget. Please anticipate a 2-4 hour meeting (additional in-person design consultation time will incur additional cost outside of the deposit). This meeting will need to take place at a scheduled time (regular business hours are Monday–Friday, 9:00 AM–5:00 PM). Availability of meeting times is not guaranteed, and the Design Consultation may be scheduled several weeks out. This Design Consultation cannot be scheduled until the New Project Introduction form is completed and the following documents have been provided: Deed, Registered Plat and/or Site Plan. If these documents cannot be found, Corey’s Construction can assist or locate them for you at your cost. Following the Design Consultation, we will need 3-4 weeks to develop your first draft (DES-1).


UP TO 2 DESIGN/BUDGET REVISIONS. (REV-1 and REV-1a). Following your review of the provided DES-1 package, Corey’s Construction asks that you list as many alterations as needed or desired on the Revision Request form. Each submitted Request form is considered one (1) revision. Whether the Revision request form has 1 alteration or 30, it counts as 1 request. This agreement will allow for 2 full Design Revisions. The first returned revision will be called REV-1. If needed, the second revision will be called REV-1a. You, the Client, agree to submit all Revision Requests using the Revision Request documents provided by Corey’s Construction. (Additional Revision Requests may be made, and will be billed at the hourly designer rate). Corey’s Construction will return Revisions in 2-3 weeks. You will be given the opportunity to do a thorough review of all completed Revision Requests to verify the revision(s) have been documented as requested. The On-Site Land Analysis Consultation must be completed prior to Corey’s Construction’s return of the first Revision Request (REV-1).


AN ON-SITE LAND ANALYSIS CONSULTATION. All requested land information must be provided prior to scheduling this consultation. The purpose of this consultation is to review and assess the needs of your lot to develop a proper site plan and budget accordingly. All site engineering is the financial responsibility of the Client. Corey’s Construction can facilitate all site development engineering at the expense of the Client. Corey’s will also provide one Surveying Stake Out. (It is the responsibility of the Client to ensure the stakes are not damaged or removed.) The area of the house and septic location must be mowed prior to the Consultation. Availability of meeting times is not guaranteed, and the meeting(s) may be scheduled several weeks out.


MAXIMUM OF FOUR HOURS FOR MATERIAL SELECTION MEETING(S). This meeting will need to be scheduled during regular business hours (Monday–Friday, 9:00 AM–5:00 PM). (This meeting may be broken into two (2) meetings if required.) Availability of meeting times is not guaranteed and these meeting(s) may be scheduled several weeks out. Full updated prints (SEL-1) will be provided within 14 days after the consultation.


UP TO 2 SELECTION/BUDGET REVISIONS. (REV-2 and REV-2a). Following your review of the provided SEL-1 package, Corey’s Construction asks that you list as many selection alterations as needed or desired on the Revision Request form. Each submitted Request form is considered one (1) revision. Whether the Revision request form has 1 alteration or 30, it counts as 1 request. This agreement will allow for 2 full Design Revisions. The first returned revision will be called REV-2. If needed, the second

A FINAL CONTRACT will be prepared once all of these items have been completed. After signing the Final Contract, Corey’s Construction will provide the necessary information to the Client’s lender to get you, the Client, to closing. It is the Client’s responsibility to facilitate closing.

GENERAL TERMS

The Client is responsible for submitting the required items in a timely manner and making them as complete as possible. Failure to do so will result in delays in expected timelines. Corey’s Construction is not responsible for the timeline of the Pre-Contract stage of the Client’s project.


As part of this agreement, you, as the Client, have read and agreed to the procedures as described in the documents Your Home: From Design Agreement to Final Contract and Turn Key at a Glance.


Corey’s Construction can only plan for permitting and construction once you, the Client, have closed on the loan and/or provided a deposit of 10% of the entire project. Your funds are necessary for the next stage.


Some design and selection alterations may not be available in certain collections. The Client may choose to upgrade to a higher collection prior to the final contract. Doing so will affect pricing and will require a higher Design Agreement deposit.


Items not included in this agreement can be additional expenses to the Client. If these costs are included in the loan, Corey’s Construction cannot facilitate those items until funds are available. Unless otherwise agreed upon, all invoices for any extra cost are due within 15 days of invoicing.


If the Client decides to terminate the Design Agreement, the Client forfeits the non-refundable deposit, and the Client will be liable for any engineering, design, or other pre-construction cost incurred to the contractor not covered under the initial deposit.
